April 29th (Tuesday) Institute of Social Sciences Methodology Seminar: 'The Double Bind of Agency and Vulnerability' (Professor Joo-Hyun Park, Yonsei University)

The Institute of Social Sciences conducts in-depth research on various methodologies and hosts Methodology Forums to promote interdisciplinary exchange. The 1st Methodology Forum of the Institute of Social Sciences for the Spring Semester of 2025 will proceed as follows, and we invite your active participation.


How does the court utilize medical records in case judgments when medical evidence is consistently introduced into legal procedures? This study analyzes the medical records of victims in acquittals of sexual violence cases from the 1980s to the 2010s. The analysis focuses on cases where victims fail to meet the court’s expected image of a "wounded yet agentic" victim. It argues that while the restrictive double bind of vulnerability and agency remains unchanged, the specific aspects of victimization have evolved in response to medical institutionalization and feminist movements—from an initial emphasis on victim resistance to a recent emphasis on credible documentation of physical and mental harm. To theorize the findings, this study develops the concept of "agentic vulnerability" and discusses the possibilities and limitations of powerful institutions and expert knowledge.
